Oorsig
Verskaf regsondersteuning aan regters en hofamptenare by die Eastern Cape-divisie van die Hooggeregshof in Makhanda, waarvoor 'n LLB-graad en drie jaar se regsonderzoekservaring vereis word.
Vereistes
- Aansoekers moet 'n LLB-graad of 'n vierjaar erkende regskwalifikasie soos deur SAQA erken, hê. 'n Minimum van drie (3) jaar se regsonderzoekservaring in die tersaaklike veld.
- Hoëghof- of litigasie-ervaring en 'n geldige bestuurderslisensie sal as 'n bykomende voordeel dien.
- Alle gekorte lys kandidate sal 'n voor-toelatings praktiese oefening onderneem as deel van die assesseringsmetode om die geskiktheid van die kandidaat te bepaal op grond van die pos se tegniese en algemene vereistes.
- Kennis en Vaardighede: Kennis van elektroniese inligtingsbronne en aanlyn ontsluiting (Westlaw, LexisNexis, Jutastat SAFLLI en Sabinet) Praktykhandleiding van die Hof, deeglike begrip van Suid-Afrikaanse reg en regstelsel, Interpretasie en toepassing van die reg, Batho Pele-beginsels, Kommunikasievaardighede (mondeling en skriftelik), probleemoplossing en besluitnemingsvaardighede, uitstekende navorsings-en analitiese vaardighede, verslagskryf- en redigeervaardighede, analitiese vaardighede, aanbiedingsvaardighede, beplannings- en organisatoriese vaardighede, rekenaargeletterdheid.
- Kommunikasie en inligtingsbestuur, akkuraatheid en aandag tot besonderhede.
- Diversiteitsbestuur, hantering van interpersoonlike konflik, projektbestuur, vermoë om onder druk te werk en tydbestuursvaardighede.
Pligte
- Verskaf ondersteuning aan regsnavorsingsfunksies vir die regters en ander hofamptenare: Verskaf ondersteuning met regsnavorsing oor verskeie regskwessies, statutte, reëls, regulasies en regspraak, ontleed en pas komplekse regsbeginsels toe en verskaf opsommings aan die regters, verskaf navorsingsondersteuning aan regters by die voorbereiding van verhore en probeerslae, voer navorsing uit en ontsluit alle materiaal uit alle bronne in beide hardekopie en elektroniese formaat oor regskwessies, soos deur 'n regter versoek, verskaf ontleding deur die bestudering van alle tersaaklike materiaal, bestudeer alle tersaaklike materiaal en verskaf 'n deeglike ontleding daarvan.
- Berei en stel regsmenings op: Verskaf ondersteuning aan die regters met ontleding van regsargumente wat deur litigante ingedien is, evalueer meriete van elke argument, ondersoek ondersteunende en teenoorgestelde regspraak (presedent) en verskaf aanbevelings aan die regters, hersien regskwessies, argumente en tersaaklike regspraak in die vorm van regsmemos, berei 'n omvattende memorandum voor oor die uitkoms van die regsnavorsing.
- Verskaf ondersteuning met die opstel van duidelike, konsekwente en omvattende uitsprake: Verskaf ondersteuning aan regters by die hersiening en proeflees van konsepuitsprake om duidelikheid en akkuraatheid te verseker, proeflees alle uitsprake, artikels, toesprake en konferensiepapake ten opsigte van spelling en grammatika, gehalteverseker alle verwysings, volledige aanhaling van uitsprake en voetnote in alle konsepuitsprake en regsartikels teen die oorspronklike teks om korrektheid en akkuraatheid te verseker, korrigeer foute (tikfoute) met behulp van 'track changes' sodat regters enige voorgestelde veranderinge kan aanvaar of van die hand wys.
- Verseker dat regters op hoogte is van onlangse ontwikkelinge in regspraak, praktykriglyne en wetgewing: Gehalteverseker die handhawing van kennis van onlangse regsontwikkelings, nuwe wetgewing en tersaaklike regspraak, verskaf ondersteuning aan die monitering van regstydskrifte, verseker dat regters toegang het tot die jongste regsinligting, hou treding met onlangse ontwikkelinge in tersaaklike regsgebiede, soos wetgewingsveranderinge, nuwe presedente en ontluikende regstendense.
